Resolution  from London Jamaat to Amend The Constitution

Notice is hereby given that in compliance with clause 17.2 of the constitution, KSIMC of London has submitted the following resolution to amend the Constitution to be tabled at the Tenth Ordinary Conference of The World Federation of KSIMC to be held in Dubai 15 - 18 September 2006.

Further to my email of 14th July and my subsequent conversation with Azadbhai Kanani who had telephoned me in response, on behalf of KSIMC of London, I hereby attach proposed constitutional amendments for your attention, and would appreciate if you could circulate the same to the members.

CONSTITUTIONAL AMENDMENTS

Proposed amendment by insertion of paragraph 3.3.6 
Any member of the executive council (as set out in paragraph 19.1.1 below) shall be entitled to raise at an executive council meeting a charge against any other member of the executive council of any contravention of this constitution. If the majority of the members of the executive council are satisfied that there exists sufficient evidence of such contravention then it shall formulate the charge to be deliberated upon at the next or any subsequent executive council meeting. At the next or subsequent meeting of the executive council where the charge is to be deliberated upon the quorum for such a meeting of the Executive Council shall not be less than 75 per centum of the members of the Executive Council and its decision shall require the support of two thirds of the members present at the meeting. The Secretary General shall not be entitled to partake in the deliberations of the Executive Council or in its decision on any such charge unless the charge is against the Secretary General in which case he will be entitled to partake in the deliberations. At the conclusion of its deliberations the Executive Council may reject the charges or find the charge proven and if the charge is proven it can reprimand or suspend the member for such period of time as it may consider appropriate.

Proposed amendment by insertion of the following sentence at the end of paragraph 19.2.5
However, any activity that falls within the jurisdiction of any member of the Federation, then the Federation shall not take part in any such activity without the written consent of that member or if it applies to a number of members then the written consent of the majority of the members would be required.

Proposed amendment by insertion of paragraph 19.2.8
Any of the non office bearer members of the Executive Council shall be entitled to raise any query in writing with any office bearer and the office bearer shall be obliged to respond to any such query in writing within a period of 4 weeks. However, the office bearer is entitled to delegate the responsibility of responding to any such query provided he is prepared to accept the responsibility of any response given on his behalf.

Proposed amendment by amending paragraph 19.1.1
Section 5 – Five ordinary councillors to be replaced by Seven Ordinary councillors
Section 6 – Five Appointed Councillors to be represented by Three Appointed Councillors
Paragraphs 19.1.2 (a) to (d) to reflect the above proposed changes.

Proposed amendment by insertion of paragraph 19.1.5 (g)
(g) in the case of ordinary and appointed councillors, if he fails to attend three consecutive Executive Council meetings.

Proposed amendment by insertion of paragraph 20.9
No one person will hold the office of The President for more than two consecutive terms of three years each. In the event clause 20.8 becomes operative, the term served by the vice president as president will not be considered as falling under clause 20.9.
